  • As of July 2020, OWNER does not collect any information from VISITOR unless VISITOR chooses to submit information to OWNER through “Contact Me” page

  • As of July 2020, OWNER does not employ any advertising companies to display ads on “www.brianlifucao.com”

  • As of July 2020, OWNER does not collect COOKIE information from VISITOR

Didn’t think this was necessary, but safety first, right? Here we go.

INFORMATION OWNER MAY COLLECT FROM VISITOR

When VISITOR use the Site or contact OWNER by e-mail, social media, SMS, telephone, or other methods, OWNER may collect and process the following data about VISITOR:

  • Information VISITOR give OWNER, including:

  • Forms filled out by VISITOR on the Site;

  • Content of correspondence with OWNER by phone, e-mail or otherwise;

  • Site registration;

  • Subscriptions or orders placed on the Site;

  • Participation in discussion boards or other social media functions on the Site;

The information VISITOR give OWNER may include VISITOR's name, address, e-mail address and phone number, date of birth, payment information, personal description, photographs or images or comments.

  • Information about VISITOR's visit, including the full URL clickstream to, through and from OWNER's Site (including date and time);

  • Pages VISITOR viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

OWNER may also collect information about VISITOR's devices (including phones, computers or other devices) where VISITOR access and visit OWNER's Sites. Such information may include unique device identifiers and mobile network information (including phone number), IP address, language and time zone, operating system, hardware version, device locations (including specific geographic locations, such as through GPS, Bluetooth or WiFi signals). As of August 2020, OWNER does not collect any of the information stated above.

INFORMATION OWNER COLLECT FROM OTHER SOURCES

OWNER also work with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, social networks such as Facebook and Twitter, search information providers, credit reference agencies, third parties who enable sign on functionality and social network integration) and may receive information about VISITOR from them.

HOW VISITOR's INFORMATION MAY BE USED

OWNER may use information held about VISITOR in the following ways:

  • To help OWNER respond to VISITOR's queries;

  • To provide VISITOR with information relevant on OWNER;

  • To provide VISITOR, or permit selected third parties to provide VISITOR, with information about other goods and services OWNER offer that are similar to those that VISITOR have already purchased or enquired about or that OWNER feel may interest VISITOR;

  • To make suggestions and recommendations to VISITOR and other users of OWNER's Site about goods or services that may interest VISITOR or them;

  • OWNER may combine information OWNER receive from other sources with information VISITOR give to OWNER and information OWNER collect about VISITOR (including information in relation to VISITOR's devices). OWNER may use this combined information for the purposes set out above.

DISCLOSURE OF VISITOR's INFORMATION

OWNER may share VISITOR's personal data with selected third parties including:

  • Business partners, suppliers and sub-contractors for the performance of any contract OWNER enter into with them or VISITOR in order to provide VISITOR with a product or service;

  • Business partners, suppliers and sub-contractors to provide VISITOR with information about promotions and offers;

  • Relevant Universal Music artists and/or their representatives;

  • Advertisers, advertising networks and social networks that require the data to select and serve relevant adverts to VISITOR and others. OWNER may also use aggregate and other information to help advertisers reach the kind of audience they want to target. OWNER may make use of the personal data OWNER have collected from VISITOR to enable OWNER to comply with OWNER's advertisers' wishes by displaying their advertisement to that target audience;

    • As of July 2020, OWNER does not employ advertising networks to show VISITORs with advertisements of any sort.

  • Analytics and search engine providers that assist OWNER in the improvement and optimisation of OWNER's Site;

  • Third parties when VISITOR consent to or request such sharing.

OWNER may disclose VISITOR's personal data to third parties:

  • In the event that OWNER sell or buy any business or assets, in which case OWNER may disclose VISITOR's personal data to the prospective seller or buyer of such business or assets;

  • If OWNER are under a duty to disclose or share VISITOR's personal data in order to comply with any legal obligation, or in order to enforce or apply OWNER's terms of use and other agreements; or to protect the rights, property, OWNER's customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction;

  • To any other third party where lawful.

STORAGE AND TRANSFER OF DATA

All the information VISITOR provide may be processed and stored, transferred or accessed by entities around the world as described in this policy. OWNER will take steps to ensure that VISITOR's data is treated securely and in accordance with this Privacy Policy. OWNER have put in place technical and organizational procedures designed to safeguard the information OWNER collected on this Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although OWNER will do OWNER's best to protect VISITOR's personal data, OWNER cannot guarantee the security of VISITOR's data transmitted to OWNER's Site; any transmission is at VISITOR's own risk.

COOKIES

OWNER's Site uses cookies and other tracking technologies to distinguish VISITOR from other users of OWNER's Site. This helps OWNER to provide VISITOR with a good experience when VISITOR browse OWNER's Site and also allows OWNER to improve OWNER's Site. SOCIAL MEDIA AND OTHER THIRD PARTIES THAT PROVIDE CONTENT, ADVERTISING OR FUNCTIONALITY ON OWNER's SERVICES

Some of the content, advertising and functionality on OWNER's Site may be provided by third parties that are not affiliated with OWNER. For example, VISITOR may have the opportunity to log in to OWNER's Site using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate VISITOR's identity and provide VISITOR the option to share certain personal data with OWNER. Services like Facebook Connect give VISITOR the option to post information about VISITOR's activities on this Site to VISITOR's profile page to share with others within VISITOR's network.

Third-party advertisers also may have a presence on OWNER's Sites. These and other third parties may collect or receive certain information about VISITOR's use of OWNER's Sites, including through the use of cookies and other Internet technologies, and this information may be collected over time and combined with information collected across different websites and online services.

 

CHILDREN

This Site is not directed toward children (as defined by local law) nor does OWNER knowingly collect information from children (as defined by local law) without parental consent except where in compliance with applicable laws.

VISITOR's RIGHTS

VISITOR may be entitled, in accordance with applicable law, to object to or request the restriction of processing of VISITOR's personal data, and to request access to, rectification, erasure, and portability of VISITOR's own personal data by contacting OWNER as described in the “Contact” section. OWNER may require VISITOR to prove VISITOR's identity with approved identification if VISITOR request this information.

VISITOR may also be entitled, in accordance with applicable law, to lodge a complaint with a supervisory authority if VISITOR consider that OWNER's processing of VISITOR's personal data infringes applicable law.

VISITOR are responsible for keeping VISITOR's information current and up-to-date. VISITOR may update VISITOR's information by contacting OWNER as described in the “Contact” section.

OWNER will retain VISITOR's information for as long as VISITOR's account is active or as needed to provide VISITOR services. OWNER will retain and use VISITOR's information as necessary to comply with OWNER's legal obligations, resolve disputes, and enforce OWNER's agreements.

If VISITOR wish to subscribe to OWNER's newsletter(s), OWNER will use VISITOR's name and email address to send the newsletter to VISITOR. Out of respect for VISITOR's privacy, VISITOR may choose to stop receiving OWNER's newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in VISITOR's account settings page or VISITOR can contact OWNER as described in the “Contact” section.

VISITOR's CALIFORNIA PRIVACY RIGHTS

California residents have certain rights regarding the collection, use, disclosure, and sale of their personal data. As defined in the California Consumer Privacy Act, OWNER engage in industry-standard advertising business practices that may be considered a sale. OWNER do not knowingly sell personal data related to children under 16 years of age.

California residents have the right to request:

·       Disclosure of personal data OWNER collect, use, disclose, and sell about VISITOR;

·       Deletion of VISITOR's personal data that OWNER maintain;

·       To opt out of the sale of VISITOR's personal data.

OWNER does not collect any personal data from VISITOR for advertising and other purposes. There are also no trackers on “www.brianlifucao.com". 

VISITOR have the right not to receive discriminatory treatment for exercising VISITOR's privacy rights.

LINKS TO THIRD PARTY WEBSITES

OWNER's Site, OWNER's newsletters and other communications may, from time to time, contain links to and from the websites of OWNER's partner networks, advertisers and affiliates. If VISITOR follow a link to any of these websites, please note that these websites have their own privacy policies and that OWNER do not accept any responsibility or liability for these policies.

CHANGES TO OWNER's PRIVACY POLICY

Any material changes OWNER may make to OWNER's privacy policy in the future will be posted on this page prior to the change becoming effective and/or OWNER will notify VISITOR through the Site or, where appropriate, by e-mail. Please check back frequently to see any updates or changes to OWNER's privacy policy.

USERS OF SITES IN THE EUROPEAN ECONOMIC AREA

This section of this Privacy Policy applies only if VISITOR use the Site from a country that is a Member State of the European Economic Area, and supplements the information in this Privacy Policy.

 

International transfers

OWNER's sharing VISITOR's personal data in accordance with this Privacy Policy, may involve transferring VISITOR's data outside the European Economic Area (EEA). Whenever OWNER transfer VISITOR's personal data out of the EEA, OWNER ensure a similar degree of protection is afforded to it by ensuring, where required by law, at least one of the following safeguards is implemented:

  • Transferring personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission;

  • Using specific contracts approved by the European Commission which give personal data the same protection it has in Europe; or

  • Transferring personal data to the United States to an entity if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the OWNER. 

Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which OWNER have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

OWNER may use cookies to collect anonymized data on users behavior on the site. OWNER may also capture what site a user has come from and what site they go to and also some demographic data (e.g. the user’s location) and OWNER may use that data to analyze user. Refer to “First things first” at the top to review how OWNER does not collect information as of July 2020.

Some of OWNER's Sites may use Google AdSense to publish advertisements, including information about VISITOR's demographics and interests. When VISITOR view or click on an advertisement a cookie will be set to help better provide advertisements that may be of interest to VISITOR on this and other websites.

Most internet browsers are automatically set up to accept cookies. However, if VISITOR want to refuse or delete any cookies (or similar technologies), please refer to the help and support area on VISITOR's internet browser for instructions on how to block or delete cookies. Please note VISITOR may not be able to take advantage of all the features of OWNER's Site, including certain personalized features, if VISITOR delete or disable cookies.

Web Beacons

OWNER, or OWNER's third party partners, may employ a software technology called web beacons (also known as web bugs, clear gifs or pixels) which helps OWNER understand what content is effective, for example by counting the number of users who have visited these pages, and to understand usage patterns. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to let OWNER know when content is viewed. In contrast to cookies, which are stored on a user’s computer hard drive, web beacons are embedded on web pages, ads, and e-mail. OWNER, or OWNER's third party partners, may tie the information gathered by web beacons to the other information OWNER collect about VISITOR.
